Terms & Conditions

Bookings, Holds & ConfirmationDates are not secured until the booking is confirmed in writing and/or payment (deposit or full fee) is received.

Proceeding with a booking, confirming availability, making payment, or otherwise instructing Max Roux to commence work will be deemed acceptance of these Terms & Conditions, which govern the agreement between Max Roux and the client.

Any variations to the agreed scope or terms must be confirmed in writing.

Work Days, Times & Overtime

Shoot times are measured from call time to wrap, as listed on the call sheet, and include reasonable breaks, travel between locations, and lunch.

These terms apply to shoots within Australian metropolitan locations (within a 25km radius of Melbourne CBD). Travel outside this radius may incur additional fees.

A full day rate applies regardless of early completion.

Overtime applies after 8 hours and is charged at 2× the standard hourly rate, calculated as one-tenth (1/10) of the agreed full-day rate per hour.

Sundays and public holidays are charged at 2× the full-day rate.

If minimum turnaround times between shoot days are not met, overtime will be charged at 2× the hourly rate until an adequate rest break is taken.

Cancellations & Postponements

Once a booking is confirmed, the following cancellation fees apply:

• 50% of the agreed fee for cancellations made within 48 hours of the scheduled call time
• 100% of the agreed fee for cancellations made within 24 hours of the scheduled call time

Where possible, postponements may be accommodated subject to availability and may be treated as a cancellation if the date cannot be rescheduled.

Payment Terms

An invoice will be issued following completion of the shoot unless otherwise agreed in writing. Payment is due within 14 days of the invoice date.

Max Roux reserves the right to withhold delivery of final materials until full payment has been received.

Late payments may incur a 10% surcharge per 30 days overdue, to the extent permitted by law.

Intellectual Property & Licensing

Copyright in all recorded materials remains the property of Max Roux until full and final payment has been received.

Upon receipt of full payment, the client is granted an exclusive, worldwide, commercial licence to use the delivered materials in accordance with the agreed usage terms.

Unless otherwise agreed in writing, Max Roux retains a non-exclusive, perpetual, royalty-free licence to use the materials for self-promotion, portfolio use, awards, exhibitions, and presentation to prospective clients.

Where credits are used, the client agrees to credit Max Roux as the service provider.

Usage

Unless otherwise agreed in writing, the agreed fee includes one (1) year of exclusive international advertising and promotional usage across all media, commencing from the date of first public use.

Usage outside this scope — including extended duration, broadcast, resale, or third-party licensing — may incur additional fees.

Self-promotional usage by Max Roux is retained in perpetuity.

Deliverables & Revisions

The quoted fee includes two (2) rounds of reasonable revisions per deliverable.

Additional revisions or changes that materially depart from the original brief may be charged at the standard editing rate.

Client Responsibilities

The client is responsible for providing accurate shoot details and briefing information, securing access to locations, and obtaining necessary permits, approvals, and talent releases.

Any delays, additional costs, or reshoots resulting from client-side issues may incur additional fees.

Limitation of Liability & Force Majeure

To the maximum extent permitted by law, Max Roux will not be liable for failure or delay in performance due to circumstances beyond reasonable control, including illness, injury, equipment failure, weather conditions, acts of nature, or government restrictions.

Where possible, reasonable efforts will be made to reschedule the shoot or refund any unused portion of the fee.

Nothing in these Terms excludes or limits any rights or guarantees available under the Australian Consumer Law.

File Delivery & Storage

Final deliverables will be supplied digitally via a download link. Files will remain available for 30 days from delivery.

Requests for re-delivery, alternate formats, or extended storage may incur additional fees.
